Terms of Use

1. The service

CrashKit is a web application that processes a highway alignment and road crash records to produce crash lists with chainage, blackspot and crash-prone stretch identification, charts and an Accident Analysis Report.

2. Licence

Subject to these terms and payment of the applicable fees, we grant your organisation a non-exclusive, non-transferable licence to use CrashKit during the licence period, within the limits of your plan (reports per month, report credits or licensed corridors). Trial and demo accounts are for evaluation and end on the date set for them.

3. Accounts

• Accounts are created by us for licensed users. Each login is for one named person and must not be shared.
• You are responsible for keeping your password confidential and for activity under your account.
• Tell us promptly if you suspect unauthorised use of your account.

4. Acceptable use

You must not:

• copy, resell, sublicense or provide the service to third parties;
• reverse engineer, decompile or attempt to extract the source code or methods of the service;
• circumvent plan limits, access controls or security measures;
• upload data you have no right to use, or use the service for any unlawful purpose.

5. Your data and results

You keep all rights in the files you upload and in the reports generated for you, and you may use the reports in your work for your clients. You grant us the rights needed to store and process your data to provide the service, as described in our Privacy Policy.

6. Engineering responsibility

CrashKit is a decision-support tool. Its outputs do not replace professional engineering judgement, site inspection or a Road Safety Audit.

• Results depend on the completeness and accuracy of the crash records and alignment data used.
• Countermeasures in reports are indicative and must be confirmed by site inspection and Road Safety Audit.
• A qualified engineer must review every report before it is issued or relied on.

7. Third-party data sources

Where the service downloads data from public portals, we do not control their availability, content or format. We will make reasonable efforts to keep the connection working, but we are not responsible for interruptions or errors in third-party data. The upload option remains available if a portal cannot be reached.

8. Fees

• Fees are as set out in your order or plan, in Indian Rupees and exclusive of GST, which is charged at the applicable rate.
• Unused monthly reports do not carry over to the next month.
• Fees paid are non-refundable, except that a report credit is returned automatically when an analysis fails.

9. Availability and changes

We aim to keep the service available at all times but do not guarantee uninterrupted operation. We may improve or change features; we will not materially reduce the core functions of a paid plan during its current term.

10. Suspension and termination

We may suspend or close an account for breach of these terms or non-payment. After the licence period ends you can no longer start new analyses; please download any results you need. Data is then handled as described in the Privacy Policy.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, or for decisions taken on the basis of reports without the professional review described in section 6. Our total liability in connection with the service is limited to the fees paid by your organisation in the three months before the claim arose.

12. Intellectual property

CrashKit, its software, methods, design and name are owned by Geo Designs & Research Pvt. Ltd. and protected by law. No rights are granted except the licence in section 2.

13. Governing law

These terms are governed by the laws of India. Courts at Vadodara, Gujarat have exclusive jurisdiction over any dispute.
